Infobyways Sales Agreement

Commission

Commission will be paid on initial project² at a rate of 20%¹.
Commission will be paid on follow up projects³ at a rate of 10%¹.
Commission will be paid on non-programming services⁴ at a rate of 10%¹.
Commission will be paid on packaged software⁵ at a rate of 20%¹.
Commission will not be paid for web hosting⁶ and web services⁷ contracted by Infobyways to other parties.
Commission will not be paid for sales to existing Infobyways customers or when another rep has previously submitted a lead.
Commission will not be paid on sales resulting from leads submitted more than one year prior to a customer purchase order.

^1. Commission is calculated as: Sales Price - Expenses Incurred (All prices set by Infobyways).
^2. Initial Project is defines as all software development and programming work specified by the first customer purchase order.
^3. Follow up Projects are defined as all software development and programming work specified in customer purchase orders dated within one year of the order date of the initial project.
^{4.Non-programming Services are defined as any services provided by Infobyways other than software development and programming, including but not limited to on-site installation, web services, and consulting.}
^{5.Packaged Software is defined as all prewritten software developed by Infobyways.}
^{6.Web Hosting is defined as rental of storage and services provided on a host computer accessible via the internet.}
^{7.Web Services are defined as automated services made available via the internet by Infobyways, typically under a monthly subscription.}

Salesperson Responsibilities

Salesperson must fill out a Project Summary form (i.e. Lead form) for all commissionable projects.
Salesperson must acquire from the customer a written purchase order accepting the terms, pricing, and conditions of Infobyways project specification.
Salesperson must fill out a Customer Satisfaction Survey form within 30 days of final billing and prior to Infobyways issuing payment of commission.

Terms

All Commissions will be paid within 30 days after receipt of all customer payments for the project. Commission will not be paid, unless otherwise agreed to, after receipt of progress payments, but only after receipt of all progress payments.

Contract may be terminated by either party with 30 days notice. All outstanding commissions will be paid for existing projects. Commission will not be paid on projects started after termination date.
